A lawsuit that threatens a $78 million liability per defendant will cause investors to demand indemnification clauses or push for licensing deals. This will compress the timeline for a settlement.

Moreover, the copyright office is watching. The U.S. Copyright Office’s 2023 report on AI and copyright called for legislative action. If this case reaches the Supreme Court, or if Congress passes a safe harbor for training data, the regulatory shift will be abrupt.

Volatility is the tax on indecision. AI companies that are currently hoarding unlicensed data are sitting on a liability that compounds daily. The smart money is either building transparent licensing pipelines or moving to synthetic data.
